REGULAMIN REZERWACJI

CRYSTAL PEAK VILLAS & ODKRYJ ZAKOPANE

Informacje podstawowe

  1. Niniejszy Regulamin określa zasady rezerwacji lokali – domów, zwanych dalej „Lokalami” – znajdujących się w ofercie na stronach internetowych:

zwanych dalej łącznie „Portalami” lub pojedynczo „Portalem”.

  1. Osoba dokonująca rezerwacji lub korzystająca z Lokalu, zwana dalej „Gościem”, zobowiązuje się do przestrzegania postanowień niniejszego Regulaminu.
  2. Lokale wynajmowane są przez:

zwaną dalej „Wynajmującym”.

  1. Informacja dotycząca podmiotu będącego Wynajmującym wybrany przez Gościa Lokal zostanie wskazana w dokumencie sprzedażowym dotyczącym rezerwacji.

  1. Wynajmujący jest małym przedsiębiorcą.
  2. Umowa pomiędzy Gościem a Wynajmującym może zostać zawarta poprzez dokonanie rezerwacji:
    • online,
    • za pośrednictwem poczty elektronicznej,
    • telefonicznie.
  3. Ceny prezentowane na Portalach mogą ulegać zmianom. Dla Gościa wiążąca jest cena obowiązująca w momencie dokonania rezerwacji.

W jaki sposób dokonać rezerwacji?

  1. Rezerwacji można dokonać:
  2. W celu dokonania rezerwacji Gość powinien:
  1. dokonać rezerwacji pobytu we wskazanym okresie, podając w szczególności imię, nazwisko oraz dane kontaktowe;
  2. uzupełnić inne dane wymagane do prawidłowej realizacji rezerwacji, jeżeli zostanie o to poproszony;
  3. dokonać zapłaty zgodnie z zasadami określonymi poniżej.
  1. Gość zobowiązany jest do zapłaty 100% wartości rezerwacji w terminie 24 godzin od momentu jej dokonania, zgodnie z instrukcjami dotyczącymi płatności przekazanymi podczas procesu rezerwacji lub w jej potwierdzeniu.
  2. Jeżeli rezerwacja dokonywana jest na mniej niż 24 godziny przed planowanym rozpoczęciem pobytu, pełna wartość rezerwacji powinna zostać uregulowana niezwłocznie, najpóźniej przed rozpoczęciem pobytu.
  3. Po dokonaniu rezerwacji Wynajmujący przesyła na wskazany przez Gościa adres e-mail potwierdzenie rezerwacji zawierające w szczególności:
    • termin pobytu,
    • nazwę lub oznaczenie zarezerwowanego Lokalu,
    • całkowitą wartość rezerwacji,
    • termin i sposób płatności,
    • rodzaj wybranej oferty,
    • warunki anulowania lub zmiany rezerwacji.
  4. Po zaksięgowaniu płatności Gość otrzyma potwierdzenie oraz informacje niezbędne do realizacji pobytu.
  5. Brak zapłaty 100% wartości rezerwacji w wymaganym terminie uprawnia Wynajmującego do anulowania rezerwacji.

Oferta elastyczna

  1. W przypadku rezerwacji dokonanej w ramach Oferty elastycznej Gość zobowiązany jest do zapłaty 100% wartości rezerwacji w terminie 24 godzin od momentu jej dokonania.
  2. Rezerwacja dokonana w ramach Oferty elastycznej może zostać bezpłatnie anulowana najpóźniej 14 dni przed planowanym dniem przyjazdu.
  3. W przypadku skutecznego anulowania rezerwacji co najmniej 14 dni przed planowanym dniem przyjazdu Gościowi przysługuje zwrot 100% wpłaconej kwoty.
  4. Zwrot środków nastąpi w terminie do 7 dni roboczych od skutecznego anulowania rezerwacji.
  5. Jeżeli anulowanie rezerwacji nastąpi na mniej niż 14 dni przed planowanym dniem przyjazdu, wpłacona kwota nie podlega zwrotowi.
  6. Niepojawienie się Gościa w dniu rozpoczęcia pobytu bez wcześniejszego skutecznego anulowania rezerwacji nie stanowi podstawy do zwrotu wpłaconej kwoty.

Oferta bezzwrotna

  1. Wynajmujący może również oferować rezerwacje na warunkach Oferty bezzwrotnej.
  2. W przypadku Oferty bezzwrotnej Gość zobowiązany jest do zapłaty 100% wartości rezerwacji w terminie 24 godzin od momentu jej dokonania.
  3. W przypadku anulowania przez Gościa rezerwacji dokonanej w ramach Oferty bezzwrotnej wpłacona kwota nie podlega zwrotowi.
  4. Szczegółowe warunki wybranej oferty są prezentowane Gościowi podczas dokonywania rezerwacji oraz w jej potwierdzeniu.

Opłata miejscowa

  1. Na terenie miejscowości, w której znajdują się Lokale, obowiązuje opłata miejscowa za każdą noc pobytu.
  2. Opłata miejscowa nie jest wliczona w cenę pobytu prezentowaną na Portalach, chyba że warunki konkretnej oferty stanowią inaczej.
  3. Opłata miejscowa pobierana jest zgodnie z obowiązującymi przepisami lokalnymi.

Faktury i paragony

  1. Jeżeli Gość chce otrzymać fakturę wystawioną na firmę lub innego podatnika, kompletne dane do faktury, w tym prawidłowy numer NIP, należy podać najpóźniej w momencie dokonywania rezerwacji.
  2. W przypadku niepodania danych do faktury na firmę podczas dokonywania rezerwacji sprzedaż może zostać zarejestrowana jako sprzedaż na rzecz konsumenta i udokumentowana paragonem fiskalnym.
  3. Późniejsze zgłoszenie potrzeby wystawienia faktury na firmę nie stanowi podstawy do anulowania wcześniej wystawionego paragonu ani do wystawienia faktury zawierającej NIP nabywcy, jeżeli numer ten nie został wskazany zgodnie z obowiązującymi przepisami.
  4. Powyższe postanowienia nie naruszają wynikających z obowiązujących przepisów prawa uprawnień konsumenta.

W jaki sposób zmienić rezerwację?

  1. Modyfikacja rezerwacji możliwa jest wyłącznie w drodze indywidualnego porozumienia z Wynajmującym.
  2. Możliwość zmiany:
    • terminu pobytu,
    • Lokalu,
    • liczby osób,
    • innych elementów rezerwacji

zależy od dostępności oraz warunków wybranej oferty.

  1. Zatwierdzenie modyfikacji rezerwacji następuje w formie potwierdzenia przesłanego pocztą elektroniczną.
  2. Gość może przenieść na inną osobę prawa i obowiązki wynikające z rezerwacji, jeżeli osoba ta przejmie wszystkie wynikające z niej obowiązki.
  3. W takim przypadku należy niezwłocznie poinformować Wynajmującego o zmianie osoby korzystającej z rezerwacji i przekazać jej dane niezbędne do realizacji pobytu.
  4. Osoba przejmująca rezerwację zobowiązana jest zaakceptować warunki rezerwacji oraz niniejszy Regulamin.

W jaki sposób anulować rezerwację?

  1. Zasady anulowania rezerwacji zależą od rodzaju oferty wybranej przez Gościa podczas dokonywania rezerwacji.
  2. W celu anulowania rezerwacji Gość powinien poinformować Wynajmującego:

Oferta elastyczna

  1. W przypadku Oferty elastycznej Gość ma prawo do bezkosztowego anulowania rezerwacji, jeżeli anulowanie nastąpi co najmniej 14 dni przed planowanym dniem przyjazdu.
  2. W przypadku anulowania rezerwacji w terminie określonym powyżej Gościowi przysługuje zwrot 100% wpłaconej kwoty.
  3. Zwrot środków nastąpi w terminie do 7 dni roboczych od skutecznego anulowania rezerwacji.
  4. W przypadku anulowania rezerwacji na mniej niż 14 dni przed planowanym dniem przyjazdu wpłacona kwota nie podlega zwrotowi.
  5. Niepojawienie się Gościa w dniu rozpoczęcia pobytu bez wcześniejszego skutecznego anulowania rezerwacji nie stanowi podstawy do zwrotu wpłaconej kwoty.

Oferta bezzwrotna

  1. W przypadku Oferty bezzwrotnej anulowanie rezerwacji przez Gościa nie uprawnia do zwrotu wpłaconej kwoty.
  2. Szczegółowe warunki konkretnej rezerwacji wskazane w jej potwierdzeniu mają zastosowanie zgodnie z rodzajem oferty wybranym przez Gościa.

Dodatkowe usługi

  1. Zwierzęta nie są akceptowane.
  2. Zgubienie kluczy do Lokalu skutkuje naliczeniem opłaty w wysokości 200 PLN.
  • 6

Informacje ogólne

  1. Dokonanie rezerwacji obiektu noclegowego jest jednoznaczne z potwierdzeniem zapoznania się z niniejszym Regulaminem i akceptacją jego postanowień.
  2. W cenę wynajmu wliczone są standardowe opłaty za media, w szczególności za gaz, energię elektryczną oraz wodę.
  3. Zdjęcia obiektów noclegowych prezentowane w ofertach na stronach internetowych mają charakter informacyjny i poglądowy.
  4. Drobne różnice dotyczące wyposażenia lub wyglądu Lokalu w stosunku do fotografii nie stanowią podstawy do roszczeń, jeżeli standard Lokalu i jego podstawowego wyposażenia odpowiada standardowi wskazanemu w ofercie.

Doba hotelowa

  1. Doba hotelowa rozpoczyna się o godzinie 16:00 w dniu przyjazdu i kończy się o godzinie 11:00 w dniu wyjazdu.
  2. Wcześniejsze zameldowanie lub późniejsze wymeldowanie możliwe jest wyłącznie po wcześniejszym uzgodnieniu z Wynajmującym oraz pod warunkiem dostępności Lokalu.
  3. Wcześniejsze zameldowanie lub późniejsze wymeldowanie może wiązać się z dodatkową opłatą.
  • 8

Meldowanie i odbiór kluczy

  1. Meldowanie i odbiór kluczy odbywają się na terenie obiektu Crystal Peak Villas przy ul. Karpielówka Boczna 21, 34-511 Kościelisko.
  2. Gość otrzymuje numer telefonu lub inną instrukcję umożliwiającą otwarcie bramy i wjazd na teren posesji.
  3. Klucze do Lokalu pozostawione są w skrytkach znajdujących się przy wejściach do budynków.
  4. W dniu przyjazdu Gość otrzyma od pracownika Odkryj Zakopane szczegółową instrukcję dotyczącą:
    • wjazdu na teren obiektu,
    • lokalizacji właściwego budynku,
    • otwarcia skrytki,
    • odbioru kluczy,
    • zameldowania.
  5. Warunkiem otrzymania kodu dostępu do obiektu oraz instrukcji dotyczących zameldowania jest:
    • wcześniejsze uregulowanie 100% wartości rezerwacji zgodnie z § 2 Regulaminu,
    • uregulowanie wymaganych opłat dodatkowych,
    • wypełnienie i podpisanie elektronicznej karty meldunkowej.
  6. W dniu zameldowania pobierana jest opłata miejscowa zgodnie z obowiązującymi przepisami lokalnymi.
  7. Jeżeli pobranie opłaty miejscowej nie jest możliwe w dniu przyjazdu, sposób oraz termin jej uregulowania zostanie uzgodniony z Gościem.
  8. Możliwość wcześniejszego zameldowania lub późniejszego wymeldowania wymaga zgody pracownika Odkryj Zakopane i zależy od dostępności oraz przygotowania Lokalu.
  9. Wcześniejsze zameldowanie lub późniejsze wymeldowanie może wiązać się z dodatkową opłatą.
  • 9

Wymeldowanie i zdanie kluczy

  1. Wymeldowanie następuje najpóźniej do godziny 11:00 w dniu wyjazdu.
  2. Po zakończeniu pobytu Goście zobowiązani są pozostawić klucze w skrytce znajdującej się przy wynajmowanym budynku, zgodnie z otrzymaną instrukcją.
  3. Nieuzgodnione przekroczenie godziny wymeldowania może skutkować naliczeniem opłaty w wysokości 200 PLN.
  4. Goście, którzy chcą przedłużyć pobyt, zobowiązani są zgłosić taką prośbę najpóźniej w przeddzień planowanego wyjazdu.
  5. Każdorazowe przedłużenie pobytu wymaga:
    • potwierdzenia przez Wynajmującego,
    • dostępności Lokalu,
    • uregulowania należności za dodatkowy okres.
  6. W przypadku braku zgody na przedłużenie pobytu Gość zobowiązany jest opuścić Lokal w terminie wynikającym z rezerwacji.
  7. Wynajmujący zastrzega sobie możliwość zabezpieczenia i przeniesienia rzeczy pozostawionych w Lokalu po zakończeniu pobytu do bezpiecznego miejsca.
  8. Gość, który nieuprawnienie przedłuży pobyt, może zostać obciążony obowiązującą stawką dobową za każdą rozpoczętą dobę oraz innymi uzasadnionymi kosztami powstałymi w związku z uniemożliwieniem realizacji kolejnej rezerwacji.

Depozyt

  1. Wynajmujący zastrzega sobie prawo do ustanowienia depozytu w wysokości 1000 PLN jako zabezpieczenia na poczet ewentualnych szkód lub innych należności związanych z pobytem.
  2. Depozyt może zostać ustanowiony w szczególności w formie preautoryzacji karty płatniczej.
  3. Depozyt może zostać wykorzystany w szczególności na pokrycie:
    • szkód wyrządzonych w Lokalu,
    • uszkodzenia lub braku wyposażenia,
    • kosztów ponadstandardowego sprzątania,
    • kosztów utraty kluczy,
    • innych należności wynikających z naruszenia Regulaminu.
  4. Jeżeli po zakończeniu pobytu nie zostaną stwierdzone szkody, braki ani inne należności obciążające Gościa, depozyt zostanie zwolniony lub zwrócony do 3 dni roboczych od dnia wymeldowania.
  5. Rzeczywisty termin udostępnienia środków może zależeć od banku lub operatora karty płatniczej.
  • 11

Parkowanie pojazdów

  1. Na jeden Lokal mogą przypadać maksymalnie dwa miejsca postojowe, zgodnie z warunkami konkretnej rezerwacji oraz dostępnością.
  2. Gość zobowiązany jest parkować wyłącznie w miejscach wyznaczonych lub wskazanych przez personel.
  3. Zabrania się pozostawiania pojazdów w miejscach innych niż wyznaczone.
  4. Gość zobowiązany jest do podania numeru rejestracyjnego pojazdu.
  5. Zabronione jest parkowanie na terenie obiektu pojazdów niezgłoszonych.

Zasady pobytu

Cisza nocna

  1. Cisza nocna obowiązuje w godzinach 22:00–7:00.
  2. Goście zobowiązani są do przestrzegania zasad dobrego sąsiedztwa oraz poszanowania spokoju innych osób.
  3. Organizowanie imprez oraz wydarzeń mogących zakłócać spokój innych Gości jest zabronione.
  4. Naruszenie ciszy nocnej lub konieczność interwencji ochrony może skutkować naliczeniem opłaty odpowiadającej rzeczywistym kosztom interwencji, do wysokości 1000 PLN.
  5. Rażące lub powtarzające się naruszenie Regulaminu może skutkować koniecznością opuszczenia Lokalu zgodnie z obowiązującymi przepisami prawa.

Odpowiedzialność za Lokal

  1. Gość ponosi odpowiedzialność za szkody wyrządzone z jego winy lub z winy osób przebywających w Lokalu na jego zaproszenie.
  2. Gość zobowiązany jest zgłosić Wynajmującemu zauważone po przyjeździe uszkodzenia, usterki lub braki w wyposażeniu możliwie niezwłocznie.
  3. Goście zobowiązani są do utrzymywania Lokalu w należytym stanie.
  4. W przypadku pozostawienia Lokalu w stanie wymagającym ponadstandardowego sprzątania Wynajmujący może naliczyć dodatkową opłatę w wysokości do 500 PLN.
  5. Goście zobowiązani są do segregowania oraz wyrzucania odpadów do odpowiednio oznaczonych pojemników.
  6. Przy każdorazowym opuszczaniu Lokalu należy:
  • zamknąć wszystkie okna,
  • prawidłowo zamknąć drzwi wejściowe,
  • wyłączyć urządzenia mogące stwarzać zagrożenie.
  1. Gość zobowiązany jest korzystać z instalacji oraz urządzeń znajdujących się w Lokalu zgodnie z zasadami bezpieczeństwa.
  2. Ze względów przeciwpożarowych zabronione jest korzystanie z urządzeń elektrycznych mogących stwarzać zagrożenie i niestanowiących standardowego wyposażenia Lokalu. Zakaz nie obejmuje zwykłych urządzeń osobistych, takich jak ładowarki, telefony, laptopy, golarki czy suszarki do włosów.
  3. Zabronione jest przemieszczanie mebli bez zgody Wynajmującego.
  4. Zgubienie kluczy do Lokalu może skutkować naliczeniem opłaty w wysokości 200 PLN.
  5. Przed opuszczeniem Lokalu Goście zobowiązani są pozostawić umyte naczynia i sprzęty kuchenne oraz wyrzucić śmieci.

Zakaz palenia

  1. W Lokalach obowiązuje całkowity zakaz palenia tytoniu oraz innych wyrobów przeznaczonych do palenia.
  2. Naruszenie zakazu może skutkować naliczeniem opłaty w wysokości 500 PLN związanej z dodatkowym sprzątaniem oraz usunięciem zapachu.
  3. Zabronione jest wyrzucanie niedopałków oraz śmieci przez balkony i okna.

Pobyt z dziećmi

  1. Jedno dziecko do lat 4 przypadające na dwoje dorosłych, śpiące z dorosłymi lub we własnym łóżeczku i niewymagające dodatkowej pościeli, może przebywać w Lokalu bez dodatkowej opłaty, o ile warunki konkretnej oferty nie stanowią inaczej.
  2. Pobyt dziecka należy zgłosić podczas dokonywania rezerwacji.

Osoby niezameldowane

  1. Liczba osób korzystających z Lokalu nie może przekraczać liczby wskazanej podczas dokonywania rezerwacji i potwierdzonej w karcie meldunkowej.
  2. Pobyt dodatkowych osób wymaga wcześniejszej zgody Wynajmującego.
  3. W przypadku przekroczenia dopuszczalnej liczby osób Wynajmujący może naliczyć dodatkową opłatę lub zastosować inne środki przewidziane obowiązującymi przepisami prawa.

Awarie

  1. Wynajmujący podejmie działania w celu usunięcia zgłoszonych usterek bez zbędnej zwłoki.
  2. W miarę możliwości usterki będą usuwane w terminie do 24 godzin od ich zgłoszenia, chyba że charakter awarii wymaga dłuższego czasu naprawy.
  3. Awarie wynikające z przyczyn niezależnych od Wynajmującego, w szczególności przerwy w dostawie mediów, Internetu lub awarie infrastruktury zewnętrznej, nie stanowią automatycznie podstawy do anulowania rezerwacji lub obniżenia ceny.
  4. Gość zobowiązany jest umożliwić pracownikom obsługi lub serwisu technicznego dostęp do Lokalu w zakresie niezbędnym do usunięcia awarii.

Siła wyższa i sytuacje wyjątkowe

  1. W przypadku wystąpienia nieprzewidywalnych okoliczności niezależnych od Wynajmującego Wynajmujący może zaproponować Gościowi Lokal zastępczy.
  2. Jeżeli z przyczyn niezależnych od Wynajmującego nie jest możliwe zapewnienie bezpieczeństwa Gościa lub prawidłowa realizacja pobytu, Wynajmujący może odstąpić od realizacji umowy.
  3. W takim przypadku wpłacone przez Gościa kwoty podlegają zwrotowi w części odpowiadającej usługom, które nie zostały wykonane.

Rzeczy pozostawione w Lokalu

  1. Wynajmujący nie ponosi odpowiedzialności za rzeczy Gościa pozostawione bez nadzoru w Lokalu, na parkingu lub w częściach wspólnych nieruchomości, z zastrzeżeniem odpowiedzialności wynikającej z bezwzględnie obowiązujących przepisów prawa.

Reklamacje

  1. Gość ma prawo złożyć reklamację dotyczącą rezerwacji, pobytu, standardu obsługi lub innych usług pozostających w zakresie odpowiedzialności Wynajmującego.
  2. Reklamację można przesłać drogą elektroniczną na adres:

rezerwacja@gorskagrupa.pl

  1. Reklamacja powinna zawierać w szczególności:
  • imię i nazwisko Gościa,
  • numer rezerwacji,
  • termin pobytu,
  • opis zdarzenia będącego przedmiotem reklamacji,
  • oczekiwany sposób rozwiązania sprawy,
  • dane kontaktowe.
  1. Reklamacja zostanie rozpatrzona bez zbędnej zwłoki, nie później niż w terminie 14 dni od jej otrzymania.
  2. Odpowiedź zostanie przesłana na adres e-mail wskazany przez Gościa lub przekazana w inny uzgodniony sposób.

Informacje o przetwarzaniu danych osobowych

Jakie dane są przetwarzane?

  1. Administrator przetwarza dane niezbędne do realizacji usług związanych z krótkotrwałym wynajmem miejsc noclegowych, w szczególności:
    • imię i nazwisko,
    • adres e-mail,
    • numer telefonu,
    • dane dotyczące dokonanej rezerwacji,
    • informacje dotyczące zarezerwowanego Lokalu,
    • termin pobytu,
    • dane wymagane do obsługi płatności i wystawienia dokumentów sprzedażowych.

Cel i podstawa przetwarzania

  1. Dane osobowe mogą być przetwarzane w szczególności w celu:
    • zawarcia i wykonania umowy,
    • dokonania oraz obsługi rezerwacji,
    • kontaktu z Gościem,
    • obsługi Gościa podczas pobytu,
    • realizacji płatności,
    • wystawiania dokumentów sprzedażowych,
    • realizacji obowiązków wynikających z przepisów prawa,
    • dochodzenia lub obrony przed ewentualnymi roszczeniami.
  2. Podstawą przetwarzania danych niezbędnych do realizacji rezerwacji jest w szczególności art. 6 ust. 1 lit. b RODO.

Prawa Gościa

  1. Osobie, której dane dotyczą, przysługuje – w przypadkach przewidzianych przepisami – prawo do:
    • dostępu do danych,
    • otrzymania kopii danych,
    • sprostowania danych,
    • usunięcia danych,
    • ograniczenia przetwarzania,
    • wniesienia sprzeciwu,
    • wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

Podanie danych

  1. Podanie danych osobowych jest dobrowolne, jednak brak danych niezbędnych do dokonania i obsługi rezerwacji może uniemożliwić zawarcie umowy oraz realizację usługi.
  2. Administrator nie dokonuje profilowania Gości w sposób wywołujący wobec nich skutki prawne wyłącznie w oparciu o zautomatyzowane przetwarzanie.
  3. Dane osobowe nie są przekazywane do państw spoza Europejskiego Obszaru Gospodarczego, chyba że takie przekazanie odbywa się zgodnie z obowiązującymi przepisami prawa.

Postanowienia końcowe

  1. Do umów zawieranych na podstawie niniejszego Regulaminu stosuje się prawo polskie.
  2. Ewentualne spory pomiędzy Wynajmującym a Gościem będą rozstrzygane przez właściwy sąd zgodnie z obowiązującymi przepisami prawa.
  3. Wynajmujący zastrzega sobie prawo do zmiany treści Regulaminu.

General information

  1. These Terms and Conditions set out the rules for booking accommodation units – houses, hereinafter referred to as the “Accommodation Units” – offered on the following websites:

hereinafter jointly referred to as the “Portals” or individually as the “Portal”.

  1. A person making a reservation or using an Accommodation Unit, hereinafter referred to as the “Guest”, agrees to comply with these Terms and Conditions.
  2. The Accommodation Units are rented by:

  1. Information identifying the entity acting as the Landlord of the Accommodation Unit selected by the Guest will be stated in the sales document relating to the reservation.

  1. The Landlord is a small enterprise.
  2. An agreement between the Guest and the Landlord may be concluded by making a reservation:
    • online,
    • by email,
    • by telephone.
  3. Prices displayed on the Portals may change. The price binding on the Guest is the price applicable at the time the reservation is made.

How to make a reservation

  1. A reservation may be made:
  2. In order to make a reservation, the Guest should:
  1. book a stay for the selected period, providing in particular their first name, surname and contact details;
  2. provide any additional information required for the proper fulfilment of the reservation, if requested;
  3. make payment in accordance with the rules set out below.
  1. The Guest is required to pay 100% of the total reservation value within 24 hours from the time the reservation is made, in accordance with the payment instructions provided during the booking process or in the booking confirmation.
  2. If a reservation is made less than 24 hours before the scheduled start of the stay, the full reservation amount must be paid immediately and no later than before the stay begins.
  3. After the reservation has been made, the Landlord will send a booking confirmation to the email address provided by the Guest, containing in particular:
    • dates of stay,
    • name or identification of the reserved Accommodation Unit,
    • total reservation value,
    • payment deadline and method,
    • type of rate selected,
    • cancellation or amendment conditions.
  4. Once payment has been received, the Guest will receive confirmation and information necessary for the stay.
  5. Failure to pay 100% of the reservation value within the required deadline entitles the Landlord to cancel the reservation.

Flexible Rate

  1. In the case of a reservation made under the Flexible Rate, the Guest is required to pay 100% of the reservation value within 24 hours from the time the reservation is made.
  2. A reservation made under the Flexible Rate may be cancelled free of charge no later than 14 days before the scheduled arrival date.
  3. If the reservation is successfully cancelled at least 14 days before the scheduled arrival date, the Guest is entitled to a 100% refund of the amount paid.
  4. The refund will be processed within 7 business days from the effective cancellation of the reservation.
  5. If the reservation is cancelled less than 14 days before the scheduled arrival date, the amount paid is non-refundable.
  6. Failure to arrive on the scheduled arrival date without prior effective cancellation does not entitle the Guest to a refund.

Non-refundable Rate

  1. The Landlord may also offer reservations under a Non-refundable Rate.
  2. Under the Non-refundable Rate, the Guest is required to pay 100% of the reservation value within 24 hours from the time the reservation is made.
  3. If the Guest cancels a reservation made under the Non-refundable Rate, the amount paid is non-refundable.
  4. Detailed conditions of the selected rate are presented to the Guest during the booking process and in the booking confirmation.

Local tourist tax

  1. A local tourist tax applies in the municipality where the Accommodation Units are located and is charged for each night of the stay.
  2. The local tourist tax is not included in the accommodation price displayed on the Portals unless the conditions of the specific offer expressly state otherwise.
  3. The local tourist tax is collected in accordance with applicable local regulations.

Invoices and fiscal receipts

  1. If the Guest wishes to receive an invoice issued to a company or another taxable entity, complete invoice details, including a correct VAT identification number, must be provided no later than at the time the reservation is made.
  2. If company invoice details are not provided when making the reservation, the transaction may be recorded as a consumer sale and documented with a fiscal receipt.
  3. A later request for a company invoice does not constitute grounds for cancelling a previously issued fiscal receipt or for issuing an invoice containing the purchaser’s VAT identification number if that number was not provided in accordance with applicable law.
  4. The above provisions do not affect any rights granted to consumers under applicable law.

How to amend a reservation

  1. A reservation may be amended only by individual agreement with the Landlord.
  2. The possibility of changing:
    • the dates of stay,
    • the Accommodation Unit,
    • the number of Guests,
    • other elements of the reservation

depends on availability and the conditions of the selected rate.

  1. Any amendment becomes effective once confirmed by the Landlord by email.
  2. The Guest may transfer the rights and obligations resulting from the reservation to another person, provided that this person assumes all obligations arising from the reservation.
  3. In such a case, the Guest must inform the Landlord immediately of the change and provide the details necessary to fulfil the stay.
  4. The person taking over the reservation is required to accept the booking conditions and these Terms and Conditions.

How to cancel a reservation

  1. Cancellation conditions depend on the type of rate selected by the Guest when making the reservation.
  2. In order to cancel a reservation, the Guest should notify the Landlord:

Flexible Rate

  1. Under the Flexible Rate, the Guest is entitled to cancel the reservation free of charge if the cancellation is made at least 14 days before the scheduled arrival date.
  2. If the reservation is cancelled within the period specified above, the Guest is entitled to a 100% refund of the amount paid.
  3. The refund will be processed within 7 business days from the effective cancellation of the reservation.
  4. If the reservation is cancelled less than 14 days before the scheduled arrival date, the amount paid is non-refundable.
  5. Failure to arrive on the scheduled arrival date without prior effective cancellation does not entitle the Guest to a refund.

Non-refundable Rate

  1. In the case of a Non-refundable Rate, cancellation by the Guest does not entitle the Guest to a refund of the amount paid.
  2. The detailed conditions stated in the booking confirmation apply in accordance with the rate selected by the Guest.

Additional services

  1. Pets are not accepted.
  2. Loss of the keys to the Accommodation Unit will result in a charge of PLN 200.

General information

  1. Making a reservation means that the Guest confirms that they have read and accepted these Terms and Conditions.
  2. The rental price includes standard utility charges, in particular gas, electricity and water.
  3. Photographs of the Accommodation Units presented on the websites are for informational and illustrative purposes only.
  4. Minor differences in equipment or appearance compared with the photographs do not constitute grounds for claims provided that the standard of the Accommodation Unit and its essential equipment correspond to the standard specified in the offer.

Hotel day

  1. The hotel day begins at 4:00 PM on the day of arrival and ends at 11:00 AM on the day of departure.
  2. Early check-in or late check-out is possible only by prior arrangement with the Landlord and subject to availability of the Accommodation Unit.
  3. Early check-in or late check-out may be subject to an additional fee.

Check-in and key collection

  1. Check-in and key collection take place at Crystal Peak Villas, ul. Karpielówka Boczna 21, 34-511 Kościelisko.
  2. The Guest will receive a telephone number or other instructions enabling the gate to be opened and access to the property.
  3. Keys to the Accommodation Unit are left in key boxes located by the entrances to the buildings.
  4. On the day of arrival, the Guest will receive detailed instructions from an Odkryj Zakopane employee regarding:
    • access to the property,
    • location of the correct building,
    • opening the key box,
    • collecting the keys,
    • check-in.
  5. In order to receive the access code to the property and check-in instructions, the Guest must:
    • pay 100% of the reservation value in advance in accordance with § 2 of these Terms and Conditions,
    • pay any required additional charges,
    • complete and sign the electronic registration form.
  6. The local tourist tax is collected on the day of check-in in accordance with applicable local regulations.
  7. If it is not possible to collect the local tourist tax on the arrival day, the method and deadline for payment will be agreed with the Guest.
  8. Early check-in or late check-out requires approval from an Odkryj Zakopane employee and depends on availability and preparation of the Accommodation Unit.
  9. Early check-in or late check-out may be subject to an additional fee.

Check-out and return of keys

  1. Check-out must take place no later than 11:00 AM on the day of departure.
  2. At the end of the stay, Guests are required to leave the keys in the key box located by the rented building, in accordance with the instructions provided.
  3. An unauthorised delay beyond the check-out time may result in a charge of PLN 200.
  4. Guests wishing to extend their stay are required to submit such a request no later than on the day before the scheduled departure.
  5. Any extension of the stay requires:
    • confirmation by the Landlord,
    • availability of the Accommodation Unit,
    • payment for the additional period.
  6. If the Landlord does not agree to an extension, the Guest is required to vacate the Accommodation Unit within the period specified in the reservation.
  7. The Landlord reserves the right to secure and move any belongings left in the Accommodation Unit after the end of the stay to a safe location.
  8. A Guest who remains in the Accommodation Unit without authorisation may be charged the applicable daily rate for each commenced additional day and other justified costs arising from preventing the fulfilment of a subsequent reservation.

Security deposit

  1. The Landlord reserves the right to require a security deposit of PLN 1,000 as security against possible damage or other amounts due in connection with the stay.
  2. The security deposit may be secured in particular by means of a payment card pre-authorisation.
  3. The security deposit may be used in particular to cover:
    • damage caused in the Accommodation Unit,
    • damaged or missing equipment,
    • cleaning beyond the standard scope,
    • loss of keys,
    • other amounts resulting from a breach of these Terms and Conditions.
  4. If no damage, missing items or other amounts payable by the Guest are identified after the stay, the security deposit will be released or refunded within 3 business days from the date of check-out.
  5. The actual time required for the funds to become available may depend on the bank or payment card operator.

Parking

  1. A maximum of two parking spaces may be assigned to one Accommodation Unit, in accordance with the conditions of the specific reservation and subject to availability.
  2. The Guest is required to park only in designated spaces or spaces indicated by the staff.
  3. Parking in areas other than designated parking spaces is prohibited.
  4. The Guest is required to provide the vehicle registration number.
  5. Vehicles that have not been declared are not permitted to park on the property.

Rules of stay

Quiet hours

  1. Quiet hours apply between 10:00 PM and 7:00 AM.
  2. Guests are required to observe the principles of good neighbourly conduct and respect the peace of other persons.
  3. Organising parties or events that may disturb other Guests is prohibited.
  4. Breach of quiet hours or the need for intervention by security personnel may result in a charge corresponding to the actual costs of the intervention, up to PLN 1,000.
  5. Serious or repeated breaches of these Terms and Conditions may result in the Guest being required to leave the Accommodation Unit in accordance with applicable law.

Liability for the Accommodation Unit

  1. The Guest is responsible for damage caused through their fault or the fault of persons staying in the Accommodation Unit at their invitation.
  2. The Guest is required to report any damage, defects or missing items noticed upon arrival to the Landlord as soon as possible.
  3. Guests are required to keep the Accommodation Unit in proper condition.
  4. If the Accommodation Unit is left in a condition requiring cleaning beyond the standard scope, the Landlord may charge an additional fee of up to PLN 500.
  5. Guests are required to sort and dispose of waste in appropriately designated containers.
  6. Whenever leaving the Accommodation Unit, Guests should:
  • close all windows,
  • properly lock the entrance door,
  • switch off devices that may pose a hazard.
  1. The Guest is required to use installations and equipment in the Accommodation Unit in accordance with safety rules.
  2. For fire safety reasons, the use of electrical appliances that may pose a hazard and are not part of the standard equipment of the Accommodation Unit is prohibited. This prohibition does not apply to ordinary personal devices such as chargers, mobile phones, laptops, electric shavers or hair dryers.
  3. Moving furniture without the Landlord’s consent is prohibited.
  4. Loss of the keys to the Accommodation Unit may result in a charge of PLN 200.
  5. Before leaving the Accommodation Unit, Guests are required to leave dishes and kitchen equipment washed and to dispose of rubbish.

No smoking

  1. Smoking tobacco and other smoking products is strictly prohibited in the Accommodation Units.
  2. Violation of the smoking ban may result in a charge of PLN 500 related to additional cleaning and odour removal.
  3. Throwing cigarette ends or rubbish from balconies or windows is prohibited.

Staying with children

  1. One child under 4 years of age per two adults, sleeping with the adults or in their own cot and not requiring additional bedding, may stay free of charge unless the conditions of the specific offer state otherwise.
  2. The child’s stay must be declared during the booking process.

Unregistered persons

  1. The number of persons using the Accommodation Unit may not exceed the number specified during the booking process and confirmed in the registration form.
  2. Additional Guests require the Landlord’s prior consent.
  3. If the permitted number of persons is exceeded, the Landlord may charge an additional fee or take other measures provided for under applicable law.

Breakdowns and defects

  1. The Landlord will take action to remedy reported defects without undue delay.
  2. Where possible, defects will be remedied within 24 hours from the time they are reported, unless the nature of the issue requires a longer repair period.
  3. Breakdowns resulting from circumstances beyond the Landlord’s control, including interruptions to utilities, Internet access or external infrastructure failures, do not automatically constitute grounds for cancellation or a price reduction.
  4. The Guest is required to allow staff or technical service personnel access to the Accommodation Unit to the extent necessary to remedy the issue.

Force majeure and exceptional circumstances

  1. In the event of unforeseen circumstances beyond the Landlord’s control, the Landlord may offer the Guest alternative accommodation.
  2. If, for reasons beyond the Landlord’s control, it is not possible to ensure the Guest’s safety or properly perform the stay, the Landlord may withdraw from the agreement.
  3. In such a case, amounts paid by the Guest will be refunded in the part corresponding to services that have not been provided.

Belongings left in the Accommodation Unit

  1. The Landlord is not responsible for the Guest’s belongings left unattended in the Accommodation Unit, parking area or common areas of the property, subject to liability arising from mandatory provisions of applicable law.

Complaints

  1. The Guest has the right to submit a complaint concerning the reservation, stay, service standards or other services within the Landlord’s responsibility.
  2. Complaints may be submitted by email to:

  1. A complaint should contain in particular:
  • the Guest’s first name and surname,
  • reservation number,
  • dates of stay,
  • description of the event giving rise to the complaint,
  • requested method of resolving the matter,
  • contact details.
  1. The complaint will be considered without undue delay and no later than within 14 days from receipt.
  2. The response will be sent to the email address indicated by the Guest or by another agreed method.

  1. The Data Controller processes personal data necessary for the provision of short-term accommodation services, including in particular:
    • first name and surname,
    • email address,
    • telephone number,
    • reservation details,
    • information regarding the reserved Accommodation Unit,
    • dates of stay,
    • data required for payment processing and issuing sales documents.

Purpose and legal basis of processing

  1. Personal data may be processed in particular for:
    • concluding and performing the agreement,
    • making and handling reservations,
    • contacting the Guest,
    • providing Guest services during the stay,
    • processing payments,
    • issuing sales documents,
    • fulfilling obligations resulting from applicable law,
    • pursuing or defending against possible claims.
  2. The legal basis for processing data necessary for the fulfilment of the reservation is, in particular, Article 6(1)(b) of the GDPR.

Guest rights

  1. The data subject has, where provided for by applicable law, the right to:
    • access their data,
    • receive a copy of their data,
    • rectify their data,
    • erase their data,
    • restrict processing,
    • object to processing,
    • lodge a complaint with the President of the Personal Data Protection Office.

Providing personal data

  1. Providing personal data is voluntary; however, failure to provide information necessary to make and process the reservation may prevent the conclusion of the agreement and provision of the service.
  2. The Data Controller does not make decisions concerning Guests that produce legal effects solely on the basis of automated processing.
  3. Personal data is not transferred outside the European Economic Area unless such transfer is carried out in accordance with applicable law.

Final provisions

  1. Agreements concluded under these Terms and Conditions are governed by Polish law.
  2. Any disputes between the Landlord and the Guest will be resolved by the competent court in accordance with applicable law.
  3. The Landlord reserves the right to amend these Terms and Conditions.
  4. Amendments will be published on the Portals.
  5. Amendments do not affect rights acquired by Guests under reservations made before the amendments came into force unless applicable law provides otherwise.
  6. These Terms and Conditions apply from the date of publication.
